  12. Warner has an attorney and sends an election demand letter

This letter has now been released. It does not request mediation or initiate legal action. It gives the Board another opportunity to fix the issue or request a meeting without escalating. This marks the first time Warner got an attorney involved in communication, 6 weeks after the Board turned the original homeowner request over to an attorney.

The Board has not shared the opinion letter. They claim the attorney called it a “drafting error” by M/I Homes, even though M/I homes declined to support this interpretation.

  14. Board incorrectly claims to be in “ongoing litigation” with Warner

Another homeowner with legal knowledge steps in and corrects them. Warner’s attorney has confirmed that the letter did not initiate litigation in any way.
