Thirteen homeowners asked the Board and Associa to confirm an election at the October 21 Annual Meeting. Their August 20 notice also asks for instructions for homeowners who want to run.
Todd Banvich sent the notice for the group one day after the Board president said no Tamarack seats were up for election. The notice asked for a written answer within ten business days.
What the homeowners asked for
The notice asks the Association to:
- Confirm that the October meeting will include a Board election.
- Set one-, two- and three-year terms so seats come up for election in different years.
- Allow separate nominations for each seat to be elected.
- Share the nomination form or written instructions for running.
The homeowners point to the annual-election rules in Declaration Section 11(d) and By-Laws Section 3.04. They read the documents as setting May 1, 2026 as the “Applicable Date,” which would make October 21 the first annual meeting after that date.
The notice also asks how the separate rule giving the Villas president a Tamarack Board seat will work with the election rules.
Current directors can still run
Nothing in this notice prevents any currently serving director who is otherwise eligible from seeking nomination or election in accordance with the governing documents.
The homeowners did not ask for a special meeting or start the process to remove directors. They asked the Board to share the dates, rules and records behind any different reading of the election requirements.
A community post explained the request. The Board then said it would seek its attorney's advice. The full notice is linked below with private homeowner information removed.
