The Board president said no Tamarack seats would be up for election in October. Asked just after the August 19 meeting ended, she said the directors had three-year contracts. The only opening discussed was on the separate Villas Board.
None. They're three-year contracts.
The question and answer
Stephen Warner asked which seats on the main Board would be up for election in October. After the president answered, he asked whether no seats were up.
She replied:
No. They were three years. The contract we signed was for three years.
She noted an exception for the Villas. When Warner again asked whether that meant no main-HOA election, she answered, “No.”
The exchange happened just after the meeting was adjourned. It was a spoken answer to homeowners, not a recorded Board vote.
What happened next
The next day, 13 homeowners sent a formal notice asking the Board to confirm an election at the October 21 Annual Meeting.
They cited the Covenants' annual-election and staggered-term rules. The Board later said it would seek an attorney's opinion.
