Homeowners asked to meet with the Board and Associa to settle the election question before more legal fees were incurred. Their September 14 message asked for confirmation of an October election by 5 p.m. September 18, along with instructions for people who want to run.
We are not asking the Board to concede anything in advance. We are asking for an opportunity to resolve the disagreement directly before additional costs are incurred.
An answer before the annual meeting
The message followed the August 20 notice from 13 homeowners. Banvich said they still had no clear answer about an election at the October 21 Annual Meeting.
He said a few of the homeowners had spoken with an attorney. If the Board did not confirm an election by September 18, they planned to hire that attorney to send a formal demand letter. The group had not asked for mediation and offered to meet in person.
The Board's reply
Tom Jarvis, the Villas Board president and Tamarack Board vice president, replied:
You already have cost the membership hundreds (if not thousands of dollars) by the original letter you sent earlier.
He said the previous Board's resignations caused the problem and that the attorney's opinion would be shared when received. His reply did not include a bill or exact cost.
The homeowners again offered to meet. They asked to see the written rules behind any decision not to hold an election. If an election was required, they wanted the steps for running for a seat shared in time.
September 18 was the deadline the homeowners requested. Their message described a possible demand letter; it did not announce a lawsuit or say all 13 homeowners had hired an attorney.
The next exchange about a 2028 election includes all of these messages.
